On April 3, 1963, a Milwaukee policeman swore out a complaint on information and belief charging Anthony Pipito with burglary. On the basis of the complaint a deputy clerk of the county court executed and issued a warrant for Pipitos arrest. Pipito was arrested and taken before the county court the next day. He was bound over to the circuit court for trial after a preliminary hearing on July 12th. Pipito appeared before the circuit court, Judge Herbert J. Steffes presiding, on July 26th, but he was not arraigned and his case was adjourned until September 13th. On August 8th he moved to dismiss the information on the ground that the evidence was insufficient to bind him over to the circuit court. The motion was denied September 13th, and Pipito waived the reading of the information and, on arraignment, pleaded not guilty to the charge.
